Advocacy Accomplishments for 2009

Tobacco

 

The cigarette excise tax was increased by 45 cents effective August 1, 2009.    Delaware’s per pack price will now be $1.60 ranking them 18th in the state cigarette tax ratings.

 

The General Assembly passed HB 269 requiring persons selling tobacco to demand proof of age from prospective purchasers under the age of 27.

 

Access to Care

 

The Delaware Cancer Council receives level funding for FY ’10.  Funding will remain at slightly over $ 15,500,000.00. This includes funding for the DE Cancer Treatment Program.

 

The Delaware BCCEDP received a small increase in funding to upgrade their mobile mammography van with digital equipment.

 

Introduced in the first half of the 145th th session is SB 17 which would create a statewide purchasing pool that would allow individuals and businesses to obtain the most favorable rates from the private insurance market.   This bill is still in the Senate and Health and Social Services Committee.

 

The House and Senate passed SB 35 which gives the state Insurance Commissioner the right to review and approve health insurance rates.  Health insurance rate filings will now fall under the same guidelines as other forms of insurance for sale in Delaware and rates will only be approved if they are fair and not excessive.

 

Pain

 

The Delaware Board of Medical Practice voted to adopt the Federation of State Medical Boards Model Policy for the Use of Controlled Substances for the Treatment of Pain.   

 

A Pain Leadership Forum was held in June 2009 with health care providers, regulators, and policymakers in attendance.

 

Mandates

 

SB 90 passed requiring all tanning facilities to get in person parental consent for all youth ages 15-18 using tanning facilities and bans all youth age 14 and under from using tanning facilities unless deemed medically necessary by health care professional.
